Privacy Policy

This privacy policy discloses the privacy practices for https://www.calibermind.com/ as well as any related services or applications on the website (the “Service”). It explains how Caliber UX, Inc., dba CaliberMind (“Caliber”) may collect, use, and disclose information we obtain through the Service. This privacy policy applies to personal information that is related to you and collected by the Service and is incorporated by reference into the Caliber Terms of Use at https://www.calibermind.com/tos (the 'Terms').  Any capitalized terms that we use in this policy are defined either here or in the Terms.

Please read this Privacy Policy carefully to understand our views and practices regarding your personal information and how we will treat it.  By visiting this Service, you are freely accepting and consenting to the practices in this Privacy Policy. You may withdraw your consent at any time and for any reason with effect to future data processing by contacting us at the address listed below in the Section titled “Communications”.  Without your consent, Caliber will use personal information, only insofar as such processing is permitted by applicable law (e.g., for the performance of an agreement between Caliber and you) or where such processing is necessary for compliance with a legal obligation to which Caliber is subject.

Personal information means information that is related to an individual.  Non-personal information means information that does not directly identify an individual.  Caliber collects both types of information about users. The following provides examples of the types of data that we collect from you and how we use the information.    

If you are viewing our Service to sign up as a customer  (“Customer”), on sign-up or account creation you will be requested to enter into an agreement with Caliber (“Agreement”).  That Agreement may contain additional privacy disclosures and obligations. If there is any conflict or inconsistency between the Agreement and this Privacy Policy, the Agreement prevails.

TYPES OF INFORMATION WE COLLECT FROM YOU

We collect information from you when you: use the Service; complete an application or questionnaire on the Service; and otherwise communicate with or submit information or content to us.  We may collect information from you, including, but not limited to your first and last name, e-mail, login credentials, phone number, address, and marketing preferences, if you provide it to us.    If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, and any information that you submit to us, such as a resume.    You may also provide other optional information.

TYPES OF INFORMATION COLLECTED BY THIRD PARTIES

We may also collect or receive information about you from our third-party service providers, advertising partners, marketing companies, or other third parties.   We may add that information to information that we collect directly from you.

Caliber participates in behavioral-based advertising.  This means that a third party may use technology (e.g., a cookie) to collect information about you so that they can provide advertising about products and services tailored to your interest.  That advertising may appear either on the Service, or on other web sites.

TYPES OF INFORMATION COLLECTED BY TECHNOLOGY

The Service collects and stores information that is generated automatically as you use it, including your preferences and de-identified usage statistics. To make the Services more useful to you, our servers (which may be hosted by a third-party service provider) collect information from you, including browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.  We also use Cookies (as defined below) and navigational data to gather information regarding the date and time and duration of your visit. This information includes, without limitation, characters you type, your search and browsing history, links or profiles you click, and pages you view. Like most Internet services, we automatically gather this information and store it in log files each time you visit our website or access your account on our network. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a web site.  We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our website. Persistent Cookies can be removed by following Internet browser help file directions. If you choose to disable Cookies, some areas of our website or service may not work properly.

We do not respond to browser-based "do not track" signals. Currently we do not have any third-party sites who push content to our site. We use Google Analytics and other third-party analytics on our site. Google Analytics is a web analytics service provided by Google. Google Analytics uses cookies to collect anonymous traffic data to help use analyze how users use the website. The information generated by a cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the site, compiling reports on site activity for us and providing other services relating to site activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. By using the website, you consent to the processing of data about you by Google in the manner and for the purposes described in this policy. If you have concerns relating to the usage of Google Analytics, it is possible to block Google Analytics by installing a plug-in to your browser. By using the Service, you are authorizing us to gather, parse, and retain data related to the provision of the Service.

OTHER INFORMATION

Lastly, we may collect personal information that is necessary for our legitimate interests, which will be disclosed to you at the time of collection. Caliber will use this information for the purposes of which it was collected.  

HOW WE USE YOUR INFORMATION

We use your information to: provide you with the Service; facilitate and improve our services; and communicate with you. We use your information for research and marketing purposes; identify you as a user in our system; provide improved administration of our website and services; improve the quality of experience when you interact with our website and services; send you administrative e-mail notifications; respond to your inquiries; send promotional communications; send upgrades and special offers related to our services and for other marketing purposes of ours or our third party companies; make telephone calls to you, from time to time, as a part of secondary fraud protection;  and to solicit your feedback. If you provide feedback on any of our services to us, we may use such feedback for any purpose, provided we will not associate such feedback with your information. We may also use your information for internal analysis such as analyzing user behavior in aggregate for research.

We may also use your information to fulfil other legitimate purposes permitted by applicable law.

We may use or share aggregate or de-identified information for any purpose, including for marketing purposes.

HOW WE SHARE YOUR INFORMATION

We may share your information: with our third-party service providers and vendors (for example, help desk support, marketing support, credit card processing); to comply with legal obligations or requests from law enforcement; to protect and defend our rights and property; and with your permission. Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), we may in the future.  We may share some or all of your information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy. If another company acquires our company or our assets, that company will possess the information collected by it and us and will assume the rights and obligations regarding your information collected by us as described in this Privacy Policy.

We do not rent, sell, or share your personally identifiable information with nonaffiliated companies for their direct marketing purposes, unless we have your permission. Notwithstanding, we may allow access to other data collected by the Service to enable the delivery of online advertising on this website, or otherwise facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.

The Service may offer you the ability to share your personal information through a social networking site (e.g., Facebook, Twitter, LinkedIn), using such site’s integrated tools (e.g., Facebook “Like” button, or Twitter “Tweet” button).  The use of such integrated tools enables you to share personal information about yourself with other individuals or the public, depending on the settings that you have established with such social networking site. Additionally, by making personal information available on the Service, you “opt in” to allow Caliber to provide such personal information to a social networking site without your further consent.  For more information about the purpose and scope of data collection and use in connection with such social networking site or a site’s integrated tools, please visit the privacy policies of the entities that provide these social networking sites.

Caliber may offer public discussion forums and bulletin boards.  Please note that information that you disclose in these public forums become public.  Use caution in disclosing any personal information. The Service may also allow you to exchange messages with other users.  We may store these messages in order to deliver them and allow you to manage them.

Lastly, we may also share your information to fulfil other legitimate purposes permitted by applicable law.

SECURITY OF YOUR INFORMATION

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

By using the Service or providing information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service. If we learn of a security system's breach, we may attempt to notify you electronically by posting a notice on the Service or sending an email to you.

CHILDREN'S PRIVACY

The Service is not available to those under the age of 18. We do not knowingly collect information from children under 18 and we do not want it. If we learn that we have collected any information from children under 13, we will promptly take steps to delete such information and terminate the child's account, subject to and in compliance with applicable law.

INTERNATIONAL USERS

Caliber is based, and this Service is hosted, in the United States of America.  If you are from a country outside of the United States of America with laws governing data collection, use, and disclosure that may differ from U.S. law and you provide personal information to Caliber, please note that any personal information that you provide to Caliber may be transferred to the United States of America.  By providing your personal information, you hereby specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth herein or in any terms and conditions related to the use of and access to the Service.

CHANGES TO OUR PRIVACY POLICY AND PRACTICES

We may revise this Privacy Policy, so review it periodically. We will post any adjustments to the Privacy Policy on this web page, and the revised version will be effective when it is posted. If you are concerned about how your information is used, bookmark this page and read this policy periodically.  

ACCESS AND CHOICE

You may choose to provide us with your email address for the purposes of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional communications by following the unsubscribe instructions in emails that you receive from Caliber. Although we will remove your name from our mailing list after receiving your request within the timeframe permitted by applicable law, you may still receive mailings from us that had been initiated prior to your name being removed. If you decide not to receive marketing communications, we may still send you transactional communications, such as those about your account, to fulfill orders you have made, or to ask you to rate the Services.

Caliber has implemented the following procedure that you may use to access, correct, or delete your personal information, or choose how your information is used:

You may have a right, in accordance with applicable laws, to access, update, correct, and in some cases requests deletion of the personal information that we hold about you.  When updating your personal information, we may ask you to verify your identity before we can act on your request. Any access request will be subject to the relevant fee, if any, to meet our costs in providing you with details of the information we hold about you.  We will comply with your request as soon as reasonably practicable and in accordance with applicable laws. We may need to retain certain information for recordkeeping purposes, as required under applicable legal obligations, or to complete any transactions that you began prior to requesting such change or access.

Some web browsers and devices permit you to broadcast a preference that you not be “tracked” online.  At this time Caliber does not modify your experience based upon whether such a signal is broadcast.

RETENTION OF PERSONAL INFORMATION  

Caliber retains your personal information:

  • For so long as your account is active or as needed to provide you with Services or to fulfill our contractual obligations;
  • As necessary to comply with our legal obligations, resolve disputes, and enforce our agreements; and
  • For so long as is necessary for the purposes for which we collected such personal information.

OTHER INFORMATION  

Notice to California Residents.  Under California Civil Code sections 1798.83-1798.84, California residents who have an established business relationship with Caliber are entitled to ask us for a notice describing what categories of personal customer information we share with third parties for their direct marketing purposes.  This notice will identify the categories of information shared with and will include a list of the third parties with which it is shared, along with their names and addresses. If you are a California resident and would like a copy of this notice, please submit a written request to us at the addresses listed below.

Notice to Residents of the European Economic Area.  In accordance with applicable data protection laws, you may have the right to request: access to, rectification, and erasure of your personal information; restriction of processing of personal information; objecting to certain processing of personal information; and the right to data portability.  Where any processing of personal information is solely dependent upon your consent, you have the right to withdraw such consent at any time (For example, we suggest by using the any unsubscribe link contained in an applicable marketing message, or, emailing us at the “Communications” details below).  Where you believe that we have not processed your personal information in accordance with applicable data protection laws, you may lodge a complaint with the respective supervisory authority or data protection regulator. The provision of personal information by you will be for contractual, marketing, or analytical purposes as referred to in this Privacy Policy.  If we do not have access to such personal information from you, then we will not be able to undertake certain Services for you. We may withhold information where the search for that information would require disproportionate effort or have a disproportionate effect to, for example, the cost of providing the information, the time it would take to retrieve the data, or how difficult it may be to obtain the information requested.  To exercise your rights under these provisions, please contact us at the “Communications” details below. When we receive your requests, we may ask you to verify your identity before we can act on your request.

OTHER WEBSITES  

This Privacy Policy does not apply to sites or applications offered by other companies or individuals, including third party products and services, that may be displayed as content in a search on the Service.  Caliber encourages you to read the privacy policy of any third party site or applications before transmitting personal information.

CHANGING YOUR INFORMATION

You may change any of your information in your account by sending an e-mail to us at the e-mail address set forth below.  You may request deletion of your information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements).  When we delete any information, it will be deleted from the active database, but may remain in our archives.

DISPUTE RESOLUTION  

If you believe that Caliber has not adhered to this policy, please contact us by e-mail at admin@calibermind.com.  We will do our best to address your concerns. If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation.  If we are unable to reach a resolution to the dispute, we will settle the dispute exclusively as set forth in the Terms. You may also have the right to lodge a complaint with your respective supervisory authority or data protection regulator.
